Charging, strategic litigation and the Norfolk judgment
The Local Government Association (LGA) has published a copy of a letter sent by the Centre for Adult Social Care Advice, Information and Dispute Resolution (CASCAIDr) to all English social services authorities.
The letter explains the implications of the Norfolk judgment including (among other things) the need for local policies to be reviewed to ensure that they do not discriminate against severely disabled people. The letter comes with a barbed reference to the risk of public law challenges if local authorities do not take urgent action to bring their policies into line. To access the LGA link – click here.
